Burrus was arrested on the same charges on May 28 after allegedly knocking down about 150 memorial crosses and destroying another 20 crosses with his vehicle. Police testified that 55 crosses needed to be replaced following the incident.

Security footage showed that a 1979 Ford Thunderbird entered and exited the park area at least two times shortly before 6 a.m. May 28, according to police testimony. The vehicle was driven directly through the cross display once.

Police later located a Thunderbird matching the security footage at McDonald’s on South Green Street. Police found pieces of a cross and ground stake embedded in the tires.

Burrus was located later that day and arrested. An officer testified that they could still smell alcohol on Burrus later in the day when he was arrested.
