The Rotterdam ban on sexual harassment on the street - sometimes also referred to as the cat-calling ban - is contrary to freedom of expression, the court in The Hague ruled on Thursday. It is not up to municipalities to restrict this freedom, only parliament and the Senate can decide to do so, the court ruled, NOS reports.

In 2017, Rotterdam and Amsterdam made sexual harassment on the street punishable under a General Local Regulation. Those caught cat-calling, cursing, following, or making lewd comments, among other things, face a fine up to 4,100 euros or up to three months in prison. A number of suspects have since been arrested in Rotterdam.

The first man convicted under Rotterdam’s new street harassment laws, also referred to as the catcalling ban, has been cleared by a court of appeal on the grounds that he has a right to freedom of expression.
The 36-year-old had approached two women making kissing gestures as he called out: “Hey, beautiful ladies. Where are you going?”
The man, identified only as Everon el F, had gone on to say: “Where are you from? Come to the South Side”. He then chased after the women, calling: “Hey baby, are you leaving now? Stay with me for a little longer.”

In 2017, Rotterdam published research showing that 94 percent of women aged between 18 and 45 had been harassed on the street but had not reported it.
The court’s ruling said, “In the Netherlands there is a multicultural society and in, among other things, the municipality of Rotterdam there is a strong multicultural community life in which not everyone has a good command of the Dutch language or is familiar with culturally determined behaviour.”
“Citizens who, for whatever reason, cannot express themselves through language, must be able to use gestures.”

Let me guess, "Everon" isn't Irish. Even if any speech is "freedom of expression," that ended once it started pursuing its would-be al-dikk victims.
