Southport Nigger Police Chief Gary Lee Smith was indicted by a grand jury this week, and now faces an additional charge.

Assistant District Attorney Glenn Emery said on Monday a grand jury received Smith’s original charges of felony conspiracy to obtain property under false pretenses, misdemeanor willfully failing to discharge duties, and misdemeanor obstruction of justice. On Wednesday, law enforcement served Smith with an additional count of obtaining property under false pretenses, Emery said. That charge was served in Superior Court.

Lt. Michael Christian Simmons of the Southport Police Department also faces the original charges against Smith. The two men are accused of working a second job for a trucking company while on duty. Investigators say the men would occasionally leave the county — even the state — while on call as police officers.

With the investigation ongoing, the entire Southport Police Department has been placed on paid leave. Based on publicly available salary information, police salaries — including those of Smith and Simmons — cost the city more than $7,500 each week.

The Brunswick County Sheriff’s Office has assumed law enforcement duties within city limits in the interim.
